1. General provisions<\/h2>\n

This Terms and Conditions define the rules for using the online store operated by:<\/p>\n

The store operates in accordance with applicable European Union law and Polish law.<\/p>\n

2. Definitions<\/h2>\n

  • Store<\/strong> \u2013 the online store operated by the Seller;<\/li>\n
  • Seller<\/strong> \u2013 MD GROUP A. Wojczyszyn S. Wojczyszyn Sp\u00f3\u0142ka Jawna;<\/li>\n
  • Customer<\/strong> \u2013 a natural person, legal entity or organizational unit placing orders;<\/li>\n
  • Consumer<\/strong> \u2013 a natural person making a purchase not directly related to business activity.<\/li>\n<\/ul>\n

    3. Placing orders<\/h2>\n

    Orders can be placed 24\/7 via the store\u2019s website.<\/p>\n

    Placing an order means acceptance of these Terms and Conditions.<\/p>\n

    The Seller reserves the right to refuse to fulfill an order in case of:<\/p>\n

    • incorrect data provided,<\/li>\n
    • lack of payment,<\/li>\n
    • technical issues,<\/li>\n
    • suspicion of unlawful activity.<\/li>\n<\/ul>\n

      4. Prices and payments<\/h2>\n

      All prices are stated in the store\u2019s applicable currency and include VAT unless stated otherwise.<\/p>\n

      The Seller reserves the right to change prices, introduce promotions, and withdraw them.<\/p>\n

      Price changes do not affect orders already placed and paid for.<\/p>\n

        The entity providing online payment services for card payments is Autopay S.A.<\/p>\n

        In case of foreign currency payments, the final transaction amount may vary depending on exchange rates, payment operators, or the Customer\u2019s bank.<\/p>\n

        5. Order fulfillment and delivery<\/h2>\n

        Order processing time is approximate and counted from the moment payment is received or the order is confirmed.<\/p>\n

        The Seller makes every effort to ensure timely fulfillment; however, delivery times are estimates and may change due to circumstances beyond the Seller\u2019s control.<\/p>\n

        The Seller is not responsible for delays resulting from:<\/p>\n

          \n
        • courier companies,<\/li>\n
        • manufacturers or suppliers,<\/li>\n
        • logistics issues,<\/li>\n
        • force majeure,<\/li>\n
        • IT system failures.<\/li>\n<\/ul>\n

          In case of temporary product unavailability, the Seller may:<\/p>\n

            \n
          • extend the delivery time,<\/li>\n
          • offer a substitute product,<\/li>\n
          • cancel the order and refund the payment.<\/li>\n<\/ul>\n

            The Customer is obliged to check the shipment in the presence of the courier. In case of damage, a damage report should be prepared.<\/p>\n

            International deliveries may require longer processing times.<\/p>\n

             <\/p>\n

            6. Right of withdrawal and returns<\/h2>\n

            The Consumer has the right to withdraw from the contract within 14 days of receiving the goods without giving any reason.<\/p>\n

            The product must be returned without undue delay, no later than 14 days after notifying withdrawal.<\/p>\n

            The Customer bears the cost of returning the product unless otherwise required by law.<\/p>\n

            Refunds will be issued using the same payment method unless otherwise agreed.<\/p>\n

            The Seller may withhold the refund until:<\/p>\n

            • the returned product is received, or<\/li>\n
            • proof of shipment is provided.<\/li>\n<\/ul>\n

              Refunds will be issued within a maximum of 14 days after the above conditions are met.<\/p>\n

              The right of withdrawal does not apply in cases specified in Article 38 of the Consumer Rights Act, in particular for:<\/p>\n

              • custom-made products,<\/li>\n
              • personalized products,<\/li>\n
              • perishable goods,<\/li>\n
              • hygienic products opened after delivery.<\/li>\n<\/ul>\n

                 <\/p>\n

                7. Complaints<\/h2>\n

                The Customer has the right to submit a complaint regarding a product or store operation.<\/p>\n

                \nComplaints should be submitted electronically to:

                A complaint should include:<\/p>\n

                  \n
                • Customer details,<\/li>\n
                • order number,<\/li>\n
                • description of the issue,<\/li>\n
                • photos or documentation if possible.<\/li>\n<\/ul>\n

                  The Seller will respond to complaints within 14 business days.<\/p>\n

                  Natural color variations resulting from monitor settings, lighting, or materials do not constitute grounds for complaint.<\/p>\n

                   <\/p>\n

                  8. Liability<\/h2>\n

                  The Seller is not responsible for:<\/p>\n

                    \n
                  • store downtime due to technical issues,<\/li>\n
                  • errors caused by incorrect data provided by the Customer,<\/li>\n
                  • courier delays,<\/li>\n
                  • temporary unavailability of the store.<\/li>\n<\/ul>\n

                    The Seller\u2019s liability towards business customers is limited to the value of the order.<\/p>\n

                     <\/p>\n

                    9. User account<\/h2>\n

                    Creating an account in the store is voluntary.<\/p>\n

                    The Customer is obliged to provide true and accurate data.<\/p>\n

                    The Seller may block an account in case of violation of the Terms or applicable law.<\/p>\n

                     <\/p>\n

                    10. Personal data<\/h2>\n

                    Personal data is processed in accordance with the Privacy Policy and applicable laws.<\/p>\n

                     <\/p>\n

                    11. International sales<\/h2>\n

                    The store offers sales within selected European Union countries.<\/p>\n

                    Delivery times for international orders are approximate and may be extended due to logistics or factors beyond the Seller\u2019s control.<\/p>\n

                    The Seller is not responsible for delays caused by foreign carriers or logistics operators.<\/p>\n

                    For international returns, the return shipping cost is borne by the Customer unless otherwise required by law.<\/p>\n

                    12. Language and governing law<\/h2>\n

                    The Terms and Conditions may be available in different language versions.<\/p>\n

                    In case of discrepancies, the Polish version shall prevail.<\/p>\n

                    Contracts concluded via the store are governed by Polish law, taking into account applicable EU consumer protection regulations.<\/p>\n

                     <\/p>\n

                    13. Warranty<\/h2>\n

                    Selected products may be covered by a 12-month warranty from the date of delivery to the Customer.<\/p>\n

                    The warranty covers only defects resulting from causes inherent in the product.<\/p>\n

                    The warranty does not cover:<\/p>\n

                      \n
                    • normal wear and tear,<\/li>\n
                    • mechanical damage,<\/li>\n
                    • improper use,<\/li>\n
                    • incorrect installation or storage,<\/li>\n
                    • damage caused by third-party interference.<\/li>\n<\/ul>\n

                      To submit a warranty claim, the Customer should contact the Seller via email and provide proof of purchase.<\/p>\n

                      The Seller reserves the right to repair, replace, or refund the product at its discretion, in accordance with applicable law.<\/p>\n

                       <\/p>\n

                      14. Final provisions<\/h2>\n

                      The Seller reserves the right to amend these Terms and Conditions.<\/p>\n

                      Changes do not affect orders placed before their entry into force.<\/p>\n

                      In matters not regulated herein, Polish law shall apply.<\/p>\n

                      All disputes shall be resolved amicably whenever possible.<\/p>\n

                      If amicable resolution is not possible, jurisdiction will be determined in accordance with applicable law.<\/p>\n

                      For disputes with business customers, the competent court shall be the court having jurisdiction over the Seller\u2019s registered office.<\/p>\n
